Online Banking Services Agreement and Disclosures

This Online Banking Services Agreement and Disclosures ("Agreement") explains the rights and responsibilities concerning the Online Banking Service (“Service”) offered to you by Pyramid Federal Credit Union. The Online Banking Service permits you to electronically initiate account transactions involving your accounts and communicate with the Credit Union. This Agreement and Disclosure describes the Electronic Funds Transfer (EFT) services and the terms for using them. Please read and retain with your records.

In this Agreement, the words "you", "your" and "yours" mean those who request and use the Credit Union Online Banking Service (also known as Online Banking and/or Mobile Banking) any joint owners of accounts accessed under this Agreement, or any authorized users of this service. The words "we," "us," and "our" mean the Credit Union. The word "account" means any one or more accounts you have with the Credit Union. By requesting and using the Online Banking Service, each of you, jointly and severally, agree to the Terms and Conditions in this Agreement, and any amendments.

By creating and using an Online Banking account, you accept these terms as published. Online Banking transactions are also subject to the terms of your Membership Agreement and/or Loan Agreement and Disclosures, as applicable. Online and Mobile banking services may be added and/or changed from time to time.

Online Banking Services Terms and Conditions

Use of this Service requires a personal computer or approved mobile device connected through an Internet or mobile service provider. You are responsible for the installation, maintenance and operation of any software and hardware used to access the Service. You may encounter telecommunication difficulties what will not allow you to use the Service. The Credit Union will not be responsible for any errors or failures involving any equipment, telephone service, Internet service, software installation or your computer or mobile device. Current and updated antivirus software is required. Undetected viruses may corrupt and destroy your programs, applications, files, and potentially even your computer hardware. Pyramid Federal Credit Union will not be responsible for any computer virus that affects your computer or software while using our Service.

Enrolling in Online Banking Services

To enroll in Online Banking you will need the following information for the PRIMARY member: account number, Social Security Number, Date of Birth and Secure Word (defined by member at time of account opening).  Users will create a Username and Password.

Username must be at least 4 characters, and contain at least 1 alpha character and only alphanumeric characters.

Passwords must be at least 8 characters, and must include at least 1 uppercase, at least 1 lowercase, at least 1 number, at least 1 special character. Password cannot be the same as username. 

You accept responsibility for protecting the integrity of the username and password to protect unauthorized transactions and account access. You agree not to disclose or otherwise make your username and password available to anyone not authorized to sign on your accounts. You understand that any joint owner you authorize to use an access code may withdraw or transfer funds from any of your accounts. If you fail to maintain the security of the username and password and the Credit Union suffers a loss, we may terminate Online Banking immediately.

Accessing Online Banking Services

After enrolling in the Online Banking Service, you must use your Username and Password to access your accounts, or enable Fingerprint or Facial Authentication on your mobile device. Keep in mind, storing passwords on your mobile device could put you at risk for unauthorized use should your device be lost or stolen.

You may reach Online Banking from our website at www.pyramidfcu.com or by downloading our Mobile App for use on a mobile device. You can use Online Banking seven (7) days a week, 24 hours a day, 365 days a year, although some or all of the Online Banking services may not be available occasionally due to emergency or scheduled system maintenance.

At the present time, you can perform the following transactions* on all accounts to which you are authorized:

  • Obtain balances and ohter information on your accounts including including savings (shares), checking (share draft), share certificates, IRAs, and loans, including Pyramid credit cards.
  • Make transfers between savings, checking and loan accounts.
  • Make mobile check deposits (Mobile App required and subjec to additional terms below).
  • Transfer advances from your line-of-credit loans(s) to personal accounts.
  • Apply for a loan.
  • Make transfers from your share accounts to other Pyramid share accounts that you have authorization for transfer.
  • Make stop payment requests on single or multiple checks.
  • Set up and pay bills online (subject to additional terms on enrollment).
  • Review account history.
  • View check copies and re-order checks.
  • Enroll in and view electronic statements (eStatements).
  • Set up alerts and notifications.
  • Send secure messages to Credit Union through Online Message Center

Transfer and Service Limitations

Federal regulations limit transfers for savings accounts and money market accounts, if applicable. For all Savings and Money Market accounts, you may make no more than six (6) transfers and withdrawals from your account to another account of yours or to a third party in any month by means of a preauthorized, automatic, or Internet transfer, or by telephone order or instruction, or by check, draft, debit card or similar order. If you exceed these limitations, your account may be subject to a fee or account closure.

We will not be required to complete a withdrawal or transfer from your account(s) if you do not have enough money in the designated account(s) to cover the transaction; however, we may complete the transaction. You agree not to use Online Banking to initiate a transaction that would cause the balance in your designated account(s) to go below zero. If you have a line-of-credit, you agree not to use Online Banking to initiate a transaction that would cause the outstanding balance of your line-of-credit to go above your credit limit. We will not be required to complete such a transaction, but if we do, you agree to pay us the excess amount or improperly withdrawn amount or transferred amount immediately upon our request. We also will refuse to complete your Online Banking transactions if we have canceled your Online Banking access, or we cannot complete the transaction for security reasons.

The functions and limitations of Online Banking may be updated, without notice, at the option of the Credit Union in order to provide improved service to the membership.

Funds Availability

The account balance and transaction history information may be limited to recent account activity. Also, availability of funds for transfer or withdrawal may be limited by our Funds Availability Policy.

Liability for Unauthorized Access

Access to your accounts requires utilization of a Username and Password. You may change your Password at any time by logging into the Online Banking and updating your account security settings. You agree not to disclose or otherwise make your Username and/or Password available to anyone not authorized to sign on your accounts. If you disclose your Password to another person, whether it is intentional, accidental, or negligent action, you are responsible for any such action.

If you fail to maintain the security of your account and the Credit Union suffers a loss, we may terminate your Online Banking and Account Services immediately. You waive all present and future claims against and release the Credit Union from all responsibility for loss or damage not caused by the Credit Union’s negligence which you might incur through unauthorized transactions of any kind from your account(s).

Tell us at once if you believe that unauthorized access has occurred or someone has used your Password or has transferred or may transfer money from your account without your permission. You can notify the credit union of loss in person, by telephone, or in writing.

You must report any unauthorized electronic funds transfers (EFT) that appear in a periodic statement within 60 days to avoid liability for subsequent transfers.


BUSINESS DAYS
Regular business days are Monday through Friday, excluding federal holidays.


FEES AND CHARGES
There is currently no charge to use the Credit Union Online Banking; however any fees applicable to your accounts with the Credit Union as set forth in the Fee Schedule will apply. We will notify you of any changes as required by law. If you request a transfer from your line of credit account, such transactions may be subject to charges under the terms and conditions of your loan agreement.


Secure Communications

Because of the inherent risks of email communications, we strongly recommend using the secure Message Center within your Online Banking account to contact us regarding your Pyramid account. Do not send any personal or account information through email.

We have no liability to you whatsoever for any loss, claim, or damages arising or in any way related to our response(s) to any email or other electronic communication that we in good faith believe you have submitted to us. We have no duty to investigate the validity or to verify any email or other electronic communication; and may respond to any email at either the address provided with the communication, the email address in your Membership Account Agreement, or any other application or written communication actually received by us.

Although we have no obligation to do so, we reserve the right to require authentication of emails or electronic communications. The decision to require authentication is at the sole discretion of the Credit Union. We will have no obligation, liability or responsibility to you or any other person or company if we do not act upon or follow any instruction to us if a communication cannot be authenticated to our satisfaction.


PERIODIC STATEMENTS

You will receive a monthly account statement reflecting all of your transactions unless there is no activity in a particular month. In any case, you will receive a statement at least quarterly.

 

ERRORS AND QUESTIONS

In case of errors or questions about your Online transactions, you should notify us as soon as possible.

  • We must hear from you no later than sixty (60) days after we sent the first statement on which the problem appears.
  • Tell us your name and account number.
  • Describe the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  • Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days. We will determine whether an error occurred within ten (10) business days after we hear from you and we will correct any error promptly. If we need more time, however, we may take up to forty- five (45) days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the funds during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit your account.

We will tell you the results within three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.

If a notice of error involves an electronic fund transfer that occurred within thirty (30) days after the first deposit to the account was made, the applicable time periods for action shall be twenty (20) business days in place of ten (10) business days. If a notice of error involves an electronic fund transfer that was initiated in a foreign country or occurred within thirty (30) days after the first deposit to the account was made, the applicable time period for action shall be ninety (90) calendar days in place of forty-five (45) calendar days.

Statements and Electronic Communications

This disclosure provides important information required by the Electronic Signatures in Global and National Commerce Act (E-SIGN Act).

By continuing, you accept and agree to the terms of this agreement and authorize Pyramid FCU to provide required statements, disclosures and other notices electronically.

PERIODIC STATEMENTS

You will receive a monthly account statement reflecting all of your transactions unless there is no activity in a particular month. In any case, you will receive a statement at least quarterly.

ELECTRONIC STATEMENTS (eStatements)

You may elect to receive eStatements rather than paper statements. An Online Banking account is required to access eStatements. You will need to login to Online Banking by entering your username and password to view your eStatements. It is solely your responsibility to protect your online account from unauthorized access.

If you have agreed to electronic documents as your delivery preference, you will generally not receive documents in paper form, but you may request printed copies at any time. A fee may apply. See our current fee schedule for more information.

Email Address Required for Notification of Statement Availability
Your email address is required so that we can contact you electronically. You agree to accept responsibility for notifying us promptly if your email address changes. 

Right to Withdraw Consent
You have the right to withdraw your consent to receive your statements in electronic form at any time. If you withdraw your consent, your participation in the service will be terminated and you will subsequently receive mailed paper statements beginning with the next statement period after notification.

SYSTEM REQUIREMENTS
To access and retain eStatements, you will need a virus-protected computer with an internet connection, the latest version of Microsoft Edge, Chrome, Safari or Firefox. Historical eStatements prior to those for the year 2020 require a current version of Adobe Reader to open the documents in pdf format. You will also need adequate storage to save files or an installed printer to print them.

While eStatements can be viewed in the Pyramid FCU Mobile App, currently they cannot be saved or downloaded through the app.

SYSTEM ACCESS
Access to this service may be unavailable at times due to scheduled or unscheduled maintenance, or system outage. We will make every reasonable effort to ensure optimum availability of this system.

Mobile Deposit Terms and Conditions

Your usage of the Mobile Deposit Service constitutes your agreement with these Terms and Conditions. Updates to these terms and conditions will be made on our website.

In addition to being enrolled in our Online Banking, you must download our Mobile Banking app to a supported device, such as a smartphone, maintain your account in good standing, and comply with such restrictions on the Service as we may communicate to you from time to time. Mobile deposits can only be made through the Pyramid Mobile App.

Required Endorsement

The paper check must have a legible endorsement including your signature and the words FOR MOBILE DEPOSIT ONLY TO PYRAMID FCUwritten on the back of the check.

Use of Service:

After you login to the Pyramid FCU Mobile App:

  • Select the "+" in the yellow circle at bottom of the screen for more options
  • Select "Deposit Check." The camera will open for you to take a picture of the front of the check. Once the photo is taken, you will see a pop up for Endorsements with a reminder of the correct endosement which must be written on the back side of the check.
  • Click OK. The camera will be ready for a picture of the back side of the check.
  • Then enter the amount of the check.
  • Select the account to receive the deposit.
  • Confirm the images are clear and amount is correct, then click "Deposit Check."

Upon submission, the deposit will undergo an image quality check. Should the deposit fail this quality check, you will be prompted to retake the picture of the front and/or back of the check.

After submitting each deposit you will receive an in-app confirmation that the deposit has been submitted for processing. This notification acknowledges the receipt of the deposit but DOES NOT mean the deposit has been approved.

If your deposit repeatedly fails the quality check, or is rejected for any reason, you will be required to bring the check(s) into a branch or mail the check(s) to us for processing.

DO NOT destroy the paper check for 30 days after deposit posts to your account. 

If the deposit has been reviewed and approved, it will be posted to your qualifying account with a Mobile Deposit description.  Once the deposit has been approved the funds will be posted to your qualifying account; however, the funds will be available in accordance with the Funds Availability section below.

Funds Availability:

Our general policy is to allow you to withdraw funds deposited in your account on the first business day after the day we receive your deposit.  In some cases, we may delay your ability to withdraw funds beyond the first business day.  Then, the funds will generally be available by the second business day after the day of the deposit.  A notice of delayed availability will be mailed to you.

Deposits sent using Mobile Deposit may be submitted any time of day, weekend, or holiday. However, deposits received by us after the daily cut-off time for electronic deposits will be deposited the next business day, provided that the deposit meets all requirements. Deposits submitted on holidays or weekends will also be deposited the next business day, provided it meets all requirements. The daily cut-off time for electronic deposits is 3:00pm and is subject to change without notice to you. 

Conditions for Use:

The following items will not be accepted using Mobile Deposit:

  • Checks made payable to any person or entity other than you (third-party checks).
  • Checks made payable to CASH.
  • Checks without proper Endorsement (see above).
  • Checks which have previously been deposited and returned.
  • Checks that are not suitable for processing, including but not limited to, electronic items that are illegible and do not contain machine-readable MICR data.
  • Checks drawn on institutions located outside the United States.
  • Checks payable in denominations other than US Dollars.
  • Substitute Checks (as defined in the Check 21 Act).
  • Checks that are not in original form with an original signature, such as substitute checks or remotely created checks.
  • US Postal Money Orders, Money Grams, or traveler's checks.
  • Checks or items on which a stop payment order has been issued or for which there are insufficient funds
  • Checks containing any alteration of which you know or believe to be fraudulent or not authorized by the owner of the account on which the check is drawn.
  • Checks dated more than 180 days prior to the deposit (stale check) or with any legend included on the front of the check.
  • Checks with a date after the date of the deposit or no date.
  • Checks in amount in excess of the deposit limitations set forth herein.
  • Checks when you are not physically located in the United States.
  • Checks drawn on the same account in which you are depositing.
  • Any item that is stamped with a "non-negotiable" watermark.

Mobile Deposit Unavailability

Mobile Deposit may be unavailable temporarily due to system maintenance or technical difficulties, including those of the Internet service provider, cellular service provider and Internet software.  If for any reason the Mobile Deposit Service is not able to process your deposit, you may take your check(s) to the nearest Pyramid branch for deposit to your qualifying account or mailing the original check(s) to Pyramid Federal Credit Union, PO Box 12100, Tucson AZ 85732-2100.

Fees

Mobile Deposit is currently provided at no charge to you. We may, upon at least thirty (30) days prior notice to you, to the extent required by applicable law, charge a fee for use of this service.  If you continue to use Mobile Deposit after the fee becomes effective, you agree to pay the service fee that has been disclosed to you, as may be amended from time to time.  Further, any such service fee will be debited from the same deposit account where the check is being deposited. If your deposit account does not have sufficient funds to cover fees, you authorize us to charge any such fees to any other deposit account you maintain with us. 

Mobile Deposit Limits

We reserve the right to impose limits on the deposits you submit using this service and to modify such limits from time to time. This service is currently subject to following limits:

  • Daily Limit: The maximum cumulative amount you may deposit in a single day is $5,000.

Returns

If a paper item in a deposit is dishonored or otherwise returned for any reason, you authorize us to debit the amount of such paper item from the credited qualifying account. If there are insufficient funds in the credited qualifying account, you authorize us to collect the funds from any of your accounts. If funds are not available in any account, you agree to reimburse us for the amount of any dishonored or returned paper item. You also agree to pay any applicable fees in accordance with the Fee Schedule in effect at the time of the collection. Failure to do so may result in a charge-back to the qualified account which may cause the account to become overdraft and will be processed in accordance with our Overdraft Policy in effect.  As a last resort, we may seek other alternatives for reimbursement which could include legal channels.

Because you have retained and, after thirty (30) calendar days, destroyed the original paper item, you acknowledge that it is impossible for us to return such original to you. You agree that the paper item returned will be in the form of an electronic or paper reproduction of the original paper as defined in the Check 21 Act.

Your Warranties to Pyramid Federal Credit Union:

FAILURE TO PROTECT YOUR HARDWARE AND SECURITY CREDENTIALS MAY ALLOW AN UNAUTHORIZED PARTY TO ACCESS THE SERVICE AND TRANSMIT AN ELECTRONIC ITEM FOR DEPOSIT. ALL USES OF THE SERVICE THROUGH YOUR SECURITY CREDENTIALS WILL BE DEEMED TO BE USES AUTHORIZED BY YOU AND BE BINDING UPON YOU. YOU ASSUME THE ENTIRE RISK FOR THE FRAUDULENT OR UNAUTHORIZED USE OF YOUR SECURITY CREDENTIALS. YOU AGREE TO (i) EXERCISE RESPONSIBLE BEHAVIOR WHEN USING THE SERVICE, (ii) FOLLOW THE INSTRUCTIONS AND RECOMMENDATIONS THAT PYRAMID FEDERAL CREDIT UNION PROVIDES YOU WITH RESPECT TO THE SERVICE AND (iii) USE MAXIMUM CAUTION IN PROTECTING YOUR HARDWARE AND SECURITY CREDENTIALS FROM UNAUTHORIZED ACCESS. YOU AGREE TO NOTIFY PYRAMID FEDERAL CREDIT UNION IMMEDIATELY IF YOU BECOME AWARE OF ANY LOSS OR THEFT OF, OR ANY UNAUTHORIZED USE OF THE SERVICE OR YOUR SECURITY CREDENTIALS.

Termination:

Pyramid Federal Credit Union reserves the right to terminate, or otherwise restrict, your usage of Mobile Deposit for any reason.  In addition to complying with the Conditions of Use and Warranties above, users of this service are expected to maintain their account in good standing, which we define as having a positive balance, regular deposits, and few, if any, overdrafts.

Online Bill Pay Terms of Use

With Online Bill Pay, you can use your access device with your username and password to pay bills from your Pyramid Checking Account. Online Bill Pay does not access savings or money market accounts. You can pay the same amount or a variable amount each month. You can also choose to pay bills individually as you receive them or schedule payment of certain bills automatically each month in a fixed amount. We will withdraw funds from your primary checking account on the day you have scheduled for payment.

The Online Bill Pay system will tell you the estimated amount of time it will take for your payments to reach your Payees. You are responsible for scheduling bill payments to arrive at your payees on time. Pyramid will not have any liability to you or to any third party arising out of your use of Online Bill Pay except for actual damages (limited to late fees and interest) arising out of our failure to timely and accurately process a bill payment consistent with the instructions you enter. In no event will we be liable for alleged consequential, special, indirect or punitive damages arising out of your use of Online Bill Pay, such as alleged lost business opportunities or alleged harm to your credit standing.

An exception fee may be charged if, when using Bill Pay, an incorrect vendor name, address, customer account number or payment due is entered and we attempt to set up or send the payment. If you correct the inaccurate information before we attempt to set up or send the payment, no exception fee will be charged. Refer to the Fee Schedule.

The following limitations on Bill Pay transactions may apply: The maximum amount of bill payments each day is $2,500, if there is sufficient funds in your account.

We retain the right to restrict access to the Bill Pay Service at our sole discretion.

Stop Payment Requests

You generally cannot stop payment on Online Banking transfers once you initiate them.

You can stop scheduled Bill Pay payments that have not yet occurred by deleting the payment from the Online Bill Pay service.

Once your payment has been sent, you must handle any problems, disputes or questions directly with the payee. You can request a stop payment on checks/drafts that have not yet cleared. Refer the current Fee Schedule for fees associated with stop payment requests.

NOTICES

The Credit Union reserves the right to change the Terms and Conditions upon which this Service is offered without prior notice to you. If required, the Credit Union will mail notice to you before the effective date of any change, as required by law. Use of the Credit Union Online Banking Service is subject to existing regulations governing your accounts and any future changes to those regulations. Any use of the Service constitutes your agreement that such use is subject to the then-current version of this Agreement. 

ENFORCEMENT

You agree to be liable to the Credit Union for any liability, loss or expense as provided in this Agreement that the Credit Union incurs as a result of any dispute involving your accounts or services. You authorize the Credit Union to deduct any such liability, loss or expense from your account without prior notice to you. In the event either party brings a legal action to enforce the Agreement or collect any overdrawn funds on accounts accessed under this Agreement, the prevailing party shall be entitled, subject to applicable law, to payment by the other party of its reasonable attorney's fees and costs, including fees on any appeal, bankruptcy proceedings, or any post-judgment collection actions, if applicable.

TERMINATION OF ONLINE BANKING SERVICE

We may terminate this Agreement and your use of the Credit Union Online Banking Service if you or any authorized user of your account or Password breach this or any other agreement with us; or if we have reason to believe that there has been an unauthorized use of your account or Password.

You or any other party to your account can terminate this Agreement by notifying us in writing. Termination of service will be effective two business days following receipt of your written notice. However, termination of this Agreement will not affect the rights and responsibilities of the parties under this Agreement for transactions initiated before termination.

For security reasons, the Credit Union may terminate your Online Account with no activity for more than 60 days. You may be able to reinstate your account access by contacting the Credit Union.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with all applicable federal laws and all applicable substantive laws of the State of Arizona, and the Bylaws of the Credit Union as they now exist or may be hereafter amended. You understand that we must comply with these laws, regulations and rules. You agree that if there is any inconsistency between the terms of the Agreement and any applicable law, regulation or rule, the terms of this Agreement will prevail to the extent any such law, regulation or rule may be modified by agreement between us.

LOCATION INFORMATION

If you use our mobile banking application on your mobile device, we may collect and process information about your actual location. We use this opt-in data to provide relevant messaging, even when the app is not open on your screen, to tailor our products and services for you, and to occasionally offer you promotions of interest. You can enable or disable access to this information at any time, through your device settings.
